New rules on Andalusia holiday rentals causing confusion

With the increase in arrivals of Britishers looking to buy a Spanish property before Brexit kicks in, the introduction of new laws applying to holiday rentals in Andalusia may cause confusion.

At a seminar held in Estepona, property-owning expat attendees were informed of new regulations imposed on holiday rentals in Andalusia. The rules apply to stand-alone, furnished houses, penthouses and apartments which meet certain requirements. Properties need to be residential by nature, qualify as a holiday let with rental periods of less than two months and cannot be part of a group of more than three dwellings in the same or adjacent constructions.

Home owners advertising on the internet and allow online bookings must ensure the property or properties are properly registered, using a form available for download on the Junta de Andalusia’s website. Letting is not allowed until the property is fully registered and has been allocated a VFT number which must be shown on all internet adverts for the property. Airbnb has just announced all its properties must show a VFT number on the web page.

Renting out a property without registering it will attract fines of up to €150,000, with the Ministry of Tourism cracking down on those who don’t comply with the new rules. In Malaga alone, only 20,000 properties are already registered, with a total of 103,500 units of accommodation up for holiday rentals. For those hoping to avoid regulation, the Ministry of Tourism – aka Big Brother – will be watching, as will the Spanish tax man, as income from short-term rentals must be declared.
